Everything from misclassification to overcrowding to extreme heat and inhabitability go from mundane and innocent to intentional acts when the violations are piled on top of each other. This intentional act of deliberate indifference has been deemed by the courts to be just as actionable as direct abuse and use of force.

"Deliberate indifference" as it pertains to the unjust conditions of confinement qualify as civil rights action for Eighth Amendment lawsuits under Title 42 Section 1983 by incarcerated plaintiffs.
